MCP Credit Pty Ltd, trading as Uptain (“Company”, “we”, “our”, or “us”) is committed to protecting the privacy of our customers. This Privacy Policy sets out how we collect, store, use, and disclose information about our customers, including personal information, in accordance with applicable privacy laws. 

Scope of this Privacy Policy 

This Privacy Policy applies to all services provided by Company, including online and offline services, and all information that we collect about our customers. This Privacy Policy does not apply to any third-party websites or services that you may access through our services. 

    Your information  

    We highly value the protection of your personal information. By personal information, we refer to any data or opinion that can reveal or reasonably identify you. Our records may contain your name, age, date of birth, current and previous addresses, telephone or mobile number, email, bank information, job position, driver’s license number, passport details, financial information, and more. Additionally, information about the products and services you’ve purchased from us or inquired about, along with any supplementary details required to deliver those services and address your inquiries, is considered personal information. 

    The personal information may also encompass credit data, which is used to evaluate your eligibility for financing. This can include details of outstanding loans, your payment history, and any defaults. Usually, credit information is shared between finance providers, credit providers, and credit reporting bodies (CRBs). Personal information derived by a CRB based on the credit information held by the CRB and having any impact on an individual’s creditworthiness, past or present eligibility for credit, is referred to as “CRB Derived Information”. 

     

    You may also need to provide personal information about other individuals, such as joint applicants, co-applicants, guarantors, authorized representatives, or the contact information for your accountant or solicitor. If this is the case, we rely on you to inform those individuals that you are sharing their personal information with us and obtain their consent. Additionally, you must inform them of this policy and how they can reach us for further information (refer to the “Contact Us” section). 

     

    If you choose not to provide certain personal information, it may impact the quality of service we provide. This includes the possibility of not being able to offer the services you require, tailoring our offerings to your preferences, or having a less enjoyable or useful experience. 

    Sensitive Information 

    Sensitive information refers to personal information that pertains to your racial or ethnic background, political beliefs or affiliations, religious or philosophical convictions, union membership, sexual orientation, criminal history, health or genetic information, and specific biometric details. Although we may collect, store, use, or disclose sensitive information about you, we will only do so if it is necessary for the purposes specified in the “How We Use Your Personal Information” section of this Policy.

    How we collection personal information 

    We gather personal information in various ways, such as: 

    • directly from you, when you provide information through phone calls, application forms, agreements, or our website (e.g. during an application on uptain.com.au).

    • from joint applicants, co-applicants, or guarantors.

    • when your visit to our website.

    • from third-party sources like survey websites, competition websites, related companies, or CRBs.

    • from your representatives like solicitors, conveyancers, builders, or agents.

    • from referral partners who refer business to us.

    • from entities and organizations specified in the section “When we disclose your personal information”, including our related entities.

    • from publicly available information.

    How we use your personal information 

    Typically, we use your personal information to evaluate your credit application. Here are some of the ways we use and share your personal information: 

    • to verify your identity. 

    • to assess your application for our home loan products. 

    • to address your questions or complaints. 

    • for internal operations such as record keeping, auditing, or training.

    • for reporting and data analytics, including for regulatory, management, and research purposes.

    • to comply with legal and regulatory requirements.

    • to inform you of ways to improve the products and services we provide or to offer you additional products or services that may be of benefit to you.

    • for marketing purposes. 

      Information Sharing and Disclosure 

      We will not sell your personal information to any external party outside of Uptain. However, in order to provide the services you require we may share your personal information with entities outside of Uptain. Some of the people or organizations we may share your information with include: 

      • Our funding partners. 

      • Mortgage insurers and title insurers; 

      • Identity verification service providers. 

      • IT companies maintaining our systems and services, including cloud and data warehousing service providers. 

      • Our professional advisers such as valuers, lawyers, or auditors.

      • Government and regulatory bodies, as required by law.

      • External complaint resolution bodies.

      • Credit reporting bureaus.

      • Other financial institutions or credit providers.

      • Law enforcement agencies.

      • Your authorized representatives or advisers, or people acting on your behalf.

      Transfer of information overseas 

      To provide you with the best possible service, we may need to transfer your personal information to entities or organizations outside of Australia. This will only be done in accordance with the Australian Privacy Principles. 

      It’s important to note that some of these entities may not be subject to the same privacy obligations as those located within Australia, and they may be required to disclose information under foreign laws. In such cases, we will not be held responsible for any disclosures. 

      We do not use offshore personnel for marketing or sales purposes, and we will not share your credit information with credit reporting bodies unless they have a business presence in Australia.

      Sharing with CRBs 

      We may disclose information about you to a credit reporting bodies (CRB) when you apply for credit, have obtained credit through us, or if you are considering guaranteeing someone else’s obligations to us. When we share your information with a CRB, it may be included in reports that the CRB provides to other organizations, such as other lenders, to assess your creditworthiness. 

      Some of the information provided may negatively impact your creditworthiness, such as if you fail to make payments or commit a serious credit infringement like fraudulently obtaining credit. This type of information may impact your ability to obtain credit from other lenders. 

      Direct marketing 

      We may use your personal information to send you marketing materials regarding offers, specials, products, and services that we have available or believe may interest you. You have the option to opt out of receiving these marketing communications from us at any time by following the opt-out instructions provided. 

      Opt-out 

      You can let us know at any time if you no longer wish to receive direct marketing offers from Uptain by emailing your request to service@uptain.com.au. We will process your request as soon as we can. 

      Data Security 

      We take reasonable measures to secure your personal information from unauthorized access, use, or disclosure. However, no method of transmitting or storing electronic data is ever completely secure, and we cannot guarantee the absolute security of your information. 

      Changes to this Privacy Policy 

      We may update this Privacy Policy from time to time to reflect changes in our practices or applicable laws. We will notify you of any material changes to this Privacy Policy by posting the updated Privacy Policy on our website and, if you have provided us with your email address, by sending you an email notification. Your continued use of our services following the posting of a revised Privacy Policy constitutes your acceptance of the revised Privacy Policy.
